GA is proud to have conducted a groundbreaking study on antitrust remedies, which has played a key role in shaping the discussion at the Online Expert Workshop on Antitrust Remedies, organized by the European Commission’s DG Competition on March 27, 2025.

The study was prepared by a consortium led by the law firm GA and the economic consultancy Nera supported by monitoring trustee Thomas Hoehn and Prof. Peter Whelan. The study’s significance and impact led the Commission to dedicate an entire high-level event to examining its findings, bringing together experts, academics, and policymakers to assess the effectiveness of antitrust remedies and their enforcement in practice.

On 20 February 2025 DG Competition has published a new ex post evaluation study on the effectiveness of antitrust remedies imposed or accepted by the European Commission over the past 20 years under Articles 7 and 9 of Regulation 1/2003.

The ex post evaluation of twelve significant remedy cases suggests:

While most remedies were fully implemented, fewer than half in the selected sample were fully effective in achieving their goal. Purely behavioral remedies were less likely to be both fully implemented and effective than other forms of remedies. Implementation and effectiveness seem to have improved over time.

Further findings and the recommendations are provided in a factsheet.

DG Competition will host on 27 March 2025 an expert online workshop with the authors of the study and leading experts on antitrust remedies to discuss both the findings and the recommendations of the study. The Webex link will be shared with participants a few days before the event.
